Ally Invest Electronic Delivery of Trade and Account Information

To open and maintain an Ally Invest Securities account, you must agree to transact business with Ally Invest electronically (also see Ally Invest Electronic Signatures Disclosure). All communications, including account statements, trade confirmations, margin calls, notices, documents, data, disclosures, regulatory communications, other information, or an alert that such communication has been posted to the secure section of Ally Invest Securities LLC (“Ally Invest”) web site and is available for viewing, may be sent to you at the mailing address or email address that you provided and maintain in your account profile. When joint account holders have each provided an email address, we can deliver notice to either email address. Notice to both email addresses is not required. All communications so sent, whether in writing or otherwise, shall be deemed given to you personally, whether actually received or not.

You understand that to receive electronic delivery of notifications, you must have Internet access, a valid email address, and computer applications and devices necessary to download and save or print any information you may wish to retain. You are responsible for all the potential costs associated with access to and electronic communications regarding your account.

Emails may contain computer viruses or other defects and may not be accurately replicated on other systems. Emails may be intercepted, deleted, or affected without the knowledge of the sender or the intended recipient. Ally Invest makes no warranties in relation to these matters. Ally Invest reserves the right to intercept, monitor, and retain emails to and from its systems as permitted by applicable law. If you are not comfortable with the risks associated with email, you may decide not to use email to communicate with Ally Invest. Fees may apply.

Ally Invest Electronic Signatures Disclosure

To open and maintain an Ally Invest Securities account, you must agree to transact business with Ally Invest electronically (also see Ally Invest Electronic Delivery of Trade and Account Information Disclosure). By accepting electronic signature requirements during the online account application process, or at first login, in the case of paper applications, such electronic signature is valid evidence of your consent to be legally bound by the Ally Invest Securities Customer Agreement (Agreement) and such subsequent terms as may govern the use of our services and acceptance of notice by electronic means (described in the Electronic Delivery of Trade and Account Information Disclosure) as reasonable and proper notice, in accordance with applicable laws, rules, and regulations. Ally Invest may modify the Agreement without notice. You should check Ally Invest Disclosures  from time to time for the most up-to-date Agreement.

Ally Invest’s electronic copy of the Agreement is the true, complete, valid, authentic, and enforceable record of the Agreement, admissible in judicial or administrative proceedings to the same extent as if the documents and records were originally generated and maintained in printed form.
